And there is no inequality via the law anymore. That's all the government can do in order to ensure equality of opportunity, otherwise new inequalities are created. It is impossible to to guarantee equality of outcome ever.

People will always be racist, sexist, and whateverist. The only way to mitigate that is to have laws that treat all people equally. There's nothing free market about any of this, this is simply about treating all people equally without any special classes or protections.

What is the minority today will not always be the minority. Who is in power today will not always be in power. And lastly, people need to be treated as individuals rather than demographic groups

They didn't work because there were state and local laws that codified inequality, so it was a failure of federalism, not equality under the law

Special protections don't stop racism or bias; they create resentment and different kinds of inequality.
