No, the cases are NOT the same. As President, Trump had the authority to declassify the documents in his possession simply by using or storing them in a declassified manner. As Vice President, Biden had no such authority.

This is by far the most idiotic/dummest post of the year.

All classified documents can only be declassified by the author. I'm sure Trump nor Biden wrote any classified documents.

this is a pretty substantial leap given what is presently known

if we're assuming conspiracies...I don't see how Biden's party does this to him knowing that it has the likely effect of neutralizing the case against Trump as a side effect seeing as how they'd love to get him off the board.

Trump stated that all he had to do was "think" they were declassified and presto! If they bring charges against him over the docs and he uses this as a defense I am pretty sure it won't fly.

Every article I've read says exactly what one would expect, that the President, the leader of the branch of government responsible for classifying and declassifying documents, is the pinnacle authority for classifying and declassifying federal documents. He can declassify a document merely with how he uses or stores it.

Unless the document is classified by law. For instance a lot of atomic research stuff was classified by law passed by congress and signed into law by the president...I would have to go back and see who...but this would be an example of classification that simply can not be waived. There would also be legal consequences for possessing this information outside of its intended purpose.

Otherwise, documents classified by the executive branch can be waived by the president without limits. This is guaranteed by Article 2 of the constitution.

Article 2 section 1
The executive Power shall be vested in a President of the United States of America.


There isn't an exclusion there. THE EXECUTIVE POWER means all of it.

Excluding any of the documents that were classified by law if any....where Trump could face criminal liability is possessing property of the US government.....but the government knew he had the documents, the government shipped them to him when he left office. Prosecution is a tough road because what we have is a disagreement on the ownership of these records which should be handled federally at the district court level and not a criminal matter. Even if Trump didn't have the authority to declassify (He does) this is an administrative issue/punishment.....not criminal. He clearly didn't steal them.

There's also the matter of Joe Biden...if they prosecute Trump they have to prosecute Biden, whose criminal liability is a little more severe because he doesn't have the ability to declassify and can't make that claim. I'm guessing both wind up going nowhere...especially if Trump doesn't win the republican primary. At that point their work is done.
