The case against UNC is a slam dunk, because it is a taxpayer funded institution. Tax money should not be spent in racial discrimination. But what about Harvard? It's a private institution. Private organizations are allowed to discriminate.

Yeah, that and the whole "social institution" thing.

The Masters golf tournament is held at Augusta golf club. It doesn't allow women members. The courts say that's legal. The 60s civil rights protests were ignited because Celma and Montgomery lunch counters wouldn't serve black people. On the surface that would seem okay, because lunch counters are privately owned. Right?

Wrong. The courts determined that private lunch counters which serve the public are social institutions, that racial discrimination in social institutions discriminates on behalf of the entire community, and therefore violates the 14th Amendment.

So private universities also represent "social institutions" and must be forced not to racially discriminate.

If that's true then why wouldn't privately-owned internet forums constitute "social institutions", and be subject to the 1st Amendment's protection of free speech?

And yet military schools can still keep AA as a criteria according to Roberts
"There was a striking exception to the conservative Supreme Court majority’s decision ending race-based affirmative action in higher education on Thursday: military academies.
The U.S. government said using race as a factor in admissions to military academies can “further compelling interests,” Chief Justice John Roberts wrote in a footnote to his opinion. “This opinion… does not address the issue, in light of the potentially distinct interests that military academies may present.”
translation = not going to get enough military academy applicants to meet criteria without AA as bonus points. Need dem negroes to fill dem ranks.
