Ok, so no lawsuit exists. DOJ (according to “a source”) is looking into whether anti-trust laws were broken when auto makers colluded to all do the same things in regard to emissions.

That might actually have been illegal. Or not.

Generally when a bunch of companies get together and agree to certain terms in order to stifle competition that’s a no no. At the very least it should be looked into, which is what is being done.

As far as the emissions rules go, my personal opinion is that CA should be able to do what we want.

That being said, even Obama realized that CA setting its own standard was illegal and that’s why a waver was granted. If California has the legal right to set its own standards under federal law then no waver would be needed.

that wagged the dog, allowing him to get more stringent standards nationally
than he would have been otherwise able to negotiate outright.

That's the way it's been with weed laws and releasing certain convicts from prison. The states do their thing and it eventually catches on at the federal level.

Yes, that’s WHY he granted the wavier. But there would be no need for such a wavier if CA had the legal right to act on its own, which it did not.

This is AGAIN one of those things where a president (Obama) wielded power he shouldn’t have and nobody objected because “we all liked” what he did with that power. Well now the precedent has set and another president (Trump) is wielding THE SAME POWER and everyone who cheered the previous exercise of that power are all in huff.

Never forget (and I’ll keep beating this horse until I die) any power you allow the government to have will someday be in the hands of someone you don’t like.

And here we are right now.

The solution?

Don’t hand over so much power.
