I took this out of a movie review posted by Stockboy on the "Surfs Up" Penguins Movie post. Seemed approriate.

Bail Lowered In Surfer Murder, New Photos Surface

It was only a status conference, which is usually uneventful and routine, but not today. New information reveals behind-the-scenes negotiations, and a fifth member of the group who is helping authorities sort out exactly what happened the night a La Jolla surfer was beaten severely, which led to his death.

Seth Cravens, Orlando Osuna, Matthew Yanke and Eric House -- collectively known as the Birdrock bandits -- were back in court Wednesday in connection with the murder of popular La Jolla surfer Emery Kauanui.

Osuna's attorney James Warner did most of the talking, hoping to get his client's bail reduced from $1.2 million. His argument -- Osuna drove the getaway car, but never got out of the vehicle at Kauanui's house.

"Never hit, never touched in any way the deceased in this matter," Warner said.

Today's hearing also revealed that behind the scene discussions are underway to lessen the chargers against Osuna and Yanke.

Prosecutors say no official decision has been made regarding reduced charges, and added that their office is investigating as many as 15 other assaults possibly tied to the Birdrock Bandits.

Judge John Einhorn lowered Osuna's bail to $500,000. House and Yanke are currently free on bail. Cravens remains in custody with bail set at $2 million. It's believed he threw the fatal blow.

Craven's family sent News 8 a picture showing Seth and Emery with their arms around each other. They say they were friends for years, and that what happened was an accident and they are praying for Emery's family.

Meanwhile, the department of Alcoholic Beverage Control is now investigating the La Jolla Brew House -- where the whole fight started over a spilled drink. Investigators want to know if House and Yanke, who are both under 21, were served alcohol.

Also revealed in court today, a fifth person was in the car wit the suspects when they drove to Kauanui's house, but he is strictly a witness.

The four suspects also had a preliminary hearing date set today for Sept. 12.

I think this will be an example of "responsibility and accountability" for your actions. even the corrupted judges wont touch leniency on this one.......these punks are going to learn what being "responsible" is all about...too bad these idiots had to trash their comfy lives to learn this lesson, but ....... Just because you come from a family with a little money, that privilege doesnt make you smart.

At least they will have some pleasant memories of a rich boy's life in the past of "sleeping in late", driving their 80,000 dollar new Land Cruisers around La Jolla, acting tough and they're biggest worries were "when and where" they were going to surf all day.......Those are some nice things to reflect back on when they are "slow dancing with Bubba" in prison....for 30 years.

My prediction is that none of the defendants will go to trial, with the possible exception of Seth Cravens, who prosecuters believe is the ringleader and struck the fatal blow. He won't be offered anything under 10 years, so he may roll the dice before a jury. All will serve some jail or prison time, with the driver serving the least. None will be convicted on 1st degree murder charges.

A very sad situation all around. My condolences to family and friends.

Cravens should have taken the plea deal prior. Instead he was hit with the big one. 20 to life. Didn't see a whole lot of remorse from that kid either.
